Just a reminder

There’s a lot of brouhaha going on right now about whether or not the Republican Party should wait until the next GOP president gets sworn into office before filling Antonin Scalia’s spot on the Supreme Court.  And so I offer this little-remembered footnote to history: Harriet Miers.  For those who don’t recall the name, Ms. Miers was George W. Bush’s secretary and personal lawyer.  He also nominated her to fill a vacancy on the Supreme Court.

At first Ms. Miers refused to respond to the Judiciary Committee’s request for more information about her background.  When that didn’t go over very well, she replied with rather snippy remarks.  Because of that (and because Ms. Miers lacked the heavy federal law background that Supreme Court Justices generally have), both Republicans and Democrats quickly knocked her nomination out of the ring.  Unfortunately, after disposing of GW’s first choice, both Democrats and Republicans felt that, politically, they had to approve his second.

And that, boys and girls, is how we wound up with Samuel Alito.
