Wait a minute, my 15 minutes aren’t up yet

Unless you’ve been living in a cave all year, you’re very familiar with Kim Davis and her Kentucky Christian stance on marriage equality.  Jailed for refusing to do her job, she was finally released recently and told by the judge to at least “stand aside” and let the rest of her office do what they’re paid to do.  That means they have to issue marriage licenses according to the law, instead of according to the voices in their collective heads.  Kim Davis has decided she doesn’t want anyone to do that, and altered the licenses to remove her name from them.  Lawyer Richard Hughes filed suit on behalf of Deputy Clerk Brian Mason to bring this slight-of-hand to the court’s attention.

Mason told his attorney that Davis confiscated the original forms this week and handed out an altered form that did not include her name and does not mention the county. The new form has Mason’s name and a place for him to write his initials but not his signature.

Hughes said: “Those changes were made in some attempt to circumvent the court’s orders and may have raised to the level of interference against the court’s orders.”  Hughes said he was alerting the court because his client does not want to issue invalid licenses. Mason has been filing the appropriate paperwork, according to the notice.

State law requires marriage licenses to be issued under the authority of the county clerk. Someone else, a minister or other officiant, then performs the ceremony and signs the license. The clerk then files the license with county records.

Davis has said that any license issued – with or without her name – is not valid unless she authorizes it. However, when she was released from jail she changed the marriage license forms to say they were being issued under the authority of the federal court.

Want to guess how long it’ll be before Ms. Davis is back in jail for defying the court order?  Yeah, that was my guess as well.
